Agreement to Terms

These Terms of Service (the "Terms") constitute a legally binding agreement between you and Your Company, Inc. ("Company", "we", "us", "our") governing your access to and use of our AI website builder for landing pages and blog pages (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

Services

The Service enables users to generate, translate, edit, and publish website content using AI-assisted tools and reusable components. We may modify, suspend, or discontinue the Service (in whole or part) with notice where practicable.

Accounts & Eligibility

• You must be at least 16 years old (or older if required by your jurisdiction).
• You are responsible for safeguarding your account credentials and for all activities under your account.
• You must provide accurate information and keep it up to date.

User Content & Intellectual Property

• You retain ownership of content you provide or generate with the Service, to the extent permitted by applicable law and third‑party rights.
• You grant us a limited, non‑exclusive, worldwide license to host, process, and display your content solely to provide and improve the Service.
• Do not upload or generate content that infringes or violates the rights of others.

AI‑Generated Content

The Service may produce AI‑generated outputs based on your prompts and context. Outputs can be inaccurate or incomplete. You are responsible for reviewing outputs and ensuring compliance with applicable laws (including privacy, IP, and disclosure obligations).

Acceptable Use

• No illegal, harmful, or abusive activities.
• No attempts to reverse engineer, probe, or disrupt the Service.
• No content that is unlawful, defamatory, discriminatory, or violates privacy or IP rights.
• No automated scraping or rate‑limiting evasion.

Subscriptions, Billing & Tokens

• Free plan: up to 3 pages and a monthly token allowance for AI usage.
• Pro plan: unlimited pages, higher token limits, and automatic translations for pages (up to 10 languages).
• Fees are billed in advance per billing cycle; taxes may apply. Changes to pricing will be communicated in advance.
• Token usage reflects AI processing volume and complexity; overages may require upgrading or add‑ons.

Cancellations & Termination

• You can cancel at any time, and your plan remains active until the end of the billing period.
• We may suspend or terminate access for violations of these Terms or for security reasons.
• Upon termination, your access to the Service ends; we may retain limited records as required by law.

Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR‑FREE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

Indemnification

You agree to defend, indemnify, and hold harmless the Company from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.

Governing Law & Dispute Resolution

These Terms are governed by the laws of your principal place of business unless otherwise required by law. Any disputes will be resolved in the courts located in the same jurisdiction, except where local laws provide otherwise.
